After the plenary session of the town hall on December 27, 2016, the adjudication of new tourist licenses in Sitges was suspended for one year, and for the time being it has been extended to the present. Therefore the Sitges City Council does not grant new tourist licenses. Hence the development of a new POUM (Pla d’Ordenació Urbanística Municipal) that does not open applications for new tourist licenses, and that was approved by the plenary session of the city council on December 18, 2018. The City Council of Sitges has sent it to the Territorial Commission of Urbanism of Barcelona for its definitive approval. And the past 6/03/2019 came into force the Reial Decret-llei 7/2019.
According to the new regulations, we want to ensure that in all the municipalities of Catalonia, including Barcelona and Sitges, the number of licenses issued does not exceed 20% of the dwellings that the municipality has. During the past years in Sitges this figure was exceeded, with everything indicating that new licenses will not be issued. It is said that this limit could be applied by neighborhoods, with which some neighborhoods such as Terramar, Vallpineda or Vinyet could be below and if this restriction were applied, it would allow new owners to obtain tourist licenses. But at the moment and currently this is just a rumor and the City Council does not issue new licenses.
The aim of the new regulation is, among others, to balance the use of the houses so that there are properties as a habitual residence and thus protect the people who wish to live in the municipality. On the other hand, it aims to keep a control of the houses for tourist use and regulate the holiday rental sector. In fact it is expected that they can even withdraw tourist licenses if they do not use it, as many owners obtained the license and have never used it. If so, this would open a window for new owners to obtain a tourist license. But again this is a trend but not a reality.
On the other hand, platforms are being created for coexistence between residents and tourist homes, since in many cases many conflicts have been created when both types of properties coexist in a building. It will not be a surprise that in case of granting new licenses they are subject to new restrictions in which the neighborhood community becomes of relevant importance.
Therefore and for the moment, if you own a property without a tourist license and wish to rent it, you must rent it according to the Law of Urban Leases as a habitual residence and for a long term. Many owners are making temporary rentals without a license, but the authorities are regularizing this market and are exposed to an almost certain economic sanction.
